When a dangerous condition existed long enough that the defendant should have discovered it through reasonable inspection.
Definition
Constructive notice is implied notice based on the duration or nature of a condition. If a hazard existed long enough that a reasonable property owner with reasonable inspection procedures would have found it, the law treats them as having notice.
How it applies in personal injury cases
Common in retail slip-and-fall cases. Surveillance footage showing a spill existed for 30 minutes before the fall is the gold standard for establishing constructive notice. Inspection logs that don't document the area also help establish constructive notice.
