What is Tolling?
Pausing or extending the statute of limitations under certain circumstances.
Definition
Tolling temporarily stops the SOL clock. Common tolling triggers include the plaintiff being a minor (clock paused until age of majority in most states), legal incapacity, fraudulent concealment by the defendant, and (in some states) the defendant's absence from the state.
How it applies in personal injury cases
A case that looks expired on paper might still be timely if tolling applies. Minor plaintiffs are the most common — but tolling rules vary significantly by state. Don't reject a case automatically based on a date calculation without checking applicable tolling provisions.
