What is UM/UIM Coverage?

Uninsured Motorist (UM) and Underinsured Motorist (UIM) coverage that pays plaintiff's damages when the at-fault driver lacks adequate insurance.

Definition

UM coverage pays when the at-fault driver has no insurance. UIM coverage pays the gap between the at-fault driver's policy limits and the plaintiff's actual damages. Most states require UM coverage; UIM is required or offered in most states.

How it applies in personal injury cases

Critical when defendant policy limits are inadequate for the plaintiff's damages. In states that allow stacking, UM/UIM coverage from multiple policies can multiply the available recovery. Always confirmed at intake — many plaintiffs don't know they have it.
